Law Office of Israel D. Weinstein P.C.: Who They Are and What to Do If They Contact You About an MCA Balance
Israel D. Weinstein, Esq. is a New York attorney whose name appears on court papers as a partner of Weinstein & Weinstein, LLP of Cedarhurst, Long Island, a firm whose successor site, The Law Office of Jacob Z. Weinstein, PLLC, says it has recovered in excess of four million dollars for merchant cash advance clients. He is not a funder and not a lender. Federal filings from 2020 to 2023 show the Weinstein firm acting in merchant cash advance litigation and Israel Weinstein's name on creditor schedules in small-business bankruptcies in five states, and a New York debt-defence firm's directory says he is retained by the funder ML Factors Funding to enforce its judgments. An earlier version of this page described the Law Office of Israel D. Weinstein as an MCA funder and quoted factor rates for it. That was wrong and has been removed. If a Weinstein letter has reached you, a funder has retained counsel, and the paperwork behind your advance decides what happens next.
Who Israel D. Weinstein is
Court filings in 2020 to 2022 carry a letterhead listing Jacob Z. Weinstein, Esq. and Israel D. Weinstein, Esq. for Weinstein & Weinstein, LLP, with separate direct lines (Jacob's (646) 450-3484). The firm's website today is The Law Office of Jacob Z. Weinstein, PLLC (weinsteinllp.com), 420 Central Avenue, Suite 301, Cedarhurst, New York 11516, phone (646) 450-3484, Jacob@WeinsteinLLP.com, and it lists only Jacob Z. Weinstein on its attorneys page, a former Kings County prosecutor licensed in New York and the Southern and Eastern Districts. Its practice list runs criminal defence, federal crimes, white collar defence, fraud, breach of contract, serious injury and merchant cash advance, and the MCA page says the firm has recovered in excess of four million dollars for merchant cash advance clients through rigorous litigation and can help funders recover on a breached MCA agreement. Israel Weinstein's LinkedIn profile still names Weinstein & Weinstein, LLP. We did not find a separate website or address for a Law Office of Israel D. Weinstein, P.C., and the Better Business Bureau has no profile under either name as of September 24, 2026.
What it is not: a funder, a lender or a merchant cash advance provider. There is no Weinstein advance, no factor rate and no reconciliation clause of its own. If our earlier page led you to expect any of those, disregard it.
Where the name appears in the court record
- Lateral Recovery, LLC v. Queen Funding, LLC (S.D.N.Y. 1:21-cv-09607, filed November 19, 2021): a dispute between two merchant cash advance businesses in which Jacob Zev Weinstein appeared as counsel and filings in March and November 2022 carry the Weinstein & Weinstein letterhead naming Israel D. Weinstein, Esq.
- The H Roller Group, LLC v. C & S Global, Inc. (E.D.N.Y. 1:20-cv-05268, November 2020), a commercial case with the same letterhead.
- Creditor contact on bankruptcy schedules. Israel Weinstein's name appears in the petitions or schedules of Michael and Lisa Raso (Bankr. E.D.N.Y. 8-20-73381, 2020, the same case that lists The Business Backer c/o Roe Taroff & Taitz), Thomas and Brittany Weems (Bankr. W.D. Wash. 22-40819, 2022), Keith Gorman (Bankr. D.N.H. 22-10563, 2022), Bryan and Frank Gorman (Bankr. D. Mass., March 2023), Early Bird Pediatric Therapy Clinic (Bankr. W.D. Tex. 23-30315, 2023), Music Getaways LLC (Bankr. C.D. Cal. 9:23-bk-10256, 2023) and Speech Heart Services, LLC (Bankr. W.D. Okla. 23-11244, 2023): small businesses and owners across the country listing a New York attorney as the contact for a creditor, which is what MCA collection counsel looks like in the record.
- Caruso v. Madison Advance LLC (D. Nev. 2:25-cv-00888, filed May 20, 2025): a self-represented merchant's suit against Madison Advance, Signet Capital Group, Highland Hill Capital and individuals, in which Israel Weinstein's name appears in the filings. We have not read the pleadings, so this page does not characterise the claims.
- ML Factors Funding. The Law Office of Simon Goldenberg, a Brooklyn debt-defence firm, states in its collector directory that ML Factors Funding LLC of 456A Central Avenue, Cedarhurst, sometimes retains Israel Weinstein, Esq. to enforce and execute on the judgments it obtains in New York. That is a third party's statement, recorded here as such.

Why a business owner hears from the firm
Because a funder has retained it to sue on, or enforce a judgment on, a defaulted advance. The attorney is the funder's counsel; the agreement, the debit history, the personal guaranty and any UCC filing belong to the funder, and that paperwork decides what can be argued. Judgment enforcement means restraining notices, information subpoenas and bank levies, so a letter after a judgment should be treated as urgent.
What to establish from your own paperwork
- Which funder, which agreement and what balance. Ask in writing, at 420 Central Avenue, Suite 301, Cedarhurst, NY 11516, or at whatever address the letter gives, for the funder's name, the agreement date, the purchased and payback amounts, every debit taken and the balance claimed.
- Whether a suit or judgment already exists, and where. Search NYSCEF, Nassau County in particular, for the business name and the guarantor's name. If a summons exists, the answer deadline runs from service, usually 20 or 30 days; if a judgment exists, ask for the judgment number and whether it rests on a confession of judgment.
- The reconciliation clause. If revenue fell and the funder refused or ignored a reconciliation request, that is the centre of most MCA disputes. Pull the clause and the request history before you agree to anything.
- Whether the FDCPA applies. A merchant cash advance is a commercial transaction, so the federal Fair Debt Collection Practices Act generally does not apply. New York's rules of professional conduct and the general prohibitions on misrepresentation still bind the attorney.
- Any UCC filing, confession of judgment or personal guaranty. These decide what can be reached and how fast. See how MCA debt relief works.
If a lawsuit has been filed
The plaintiff will be the funder, with the Weinstein firm as counsel. Answer before the deadline; a default judgment ends the negotiation and opens enforcement. See what to do if a funder represented by the Weinstein firm sues.
Can the balance be settled?
Usually, if the underlying advance is real. Funders that have retained counsel still settle within limits they set, before or after judgment, and a documented revenue drop, bank statements and a realistic lump sum or schedule tend to be heard. Get the funder's sign-off, and a satisfaction of judgment where one exists, in writing. See how a balance the Weinstein firm is collecting can be settled.
Business Debt Adjusters reviews the agreement, the debit history and any filings, and tells you what is realistic before you commit to anything.
Frequently Asked Questions
Is the Law Office of Israel D. Weinstein a merchant cash advance company?
No. Israel D. Weinstein is a New York attorney whose name appears on Weinstein & Weinstein, LLP court papers in merchant cash advance litigation; the firm's successor site says it has recovered over four million dollars for MCA clients. He does not fund advances or loans.
Is the Weinstein firm legitimate?
It is a Cedarhurst, New York law practice with a published address, phone and website, attorneys admitted in New York and the federal districts, and appearances in federal cases since 2020. The BBB has no profile for it. Legitimate does not mean the balance claimed is correct; ask for the funder's name and an itemised account in writing.
Why is Israel Weinstein contacting my business?
A merchant cash advance funder has retained him to sue on or enforce a judgment on an advance, usually with the owner's personal guaranty attached. A debt-defence firm's directory names ML Factors Funding as one such client. Find out which funder, which agreement and whether a suit or judgment already exists before responding by phone.
Does the Fair Debt Collection Practices Act apply to an MCA balance a law firm is collecting?
Generally no, because a merchant cash advance is a commercial transaction. Attorney conduct rules and the general prohibitions on misrepresentation still apply, and a personal guaranty can bring the owner's own protections into play.
What should a business owner do after a letter from the Weinstein firm?
Identify the funder and the agreement, request an itemised balance and any judgment number in writing, search NYSCEF for any filed case, pull the reconciliation clause and the guaranty, and get the paperwork reviewed before agreeing to a number or missing an answer deadline.
