Empire Recovery: Who They Are and What to Do If They Contact You About an MCA Balance

Empire Recovery Solutions, listed by the BBB as Empire Recovery Services, is a New York commercial collection agency that works for merchant cash advance funders. It is not a funder and not a lender. Its own site says its team consists of lawyers and experts in the Merchant Cash Advance Industry and describes its clients as companies that extend credit to merchants. It started in November 2016, is not BBB accredited, and the BBB rates it F for failing to respond to four complaints. An earlier version of this page described Empire Recovery as an MCA funder and quoted factor rates for it. That was wrong and has been removed. If Empire Recovery is contacting you, a funder has placed your advance with it.

What Empire Recovery is

Empire Recovery Solutions (empirerecover.com), 10 West 37th Street, Room 602, New York, NY 10018, phone (201) 716-0689, inbox@empirerecover.com. The BBB carries the business as Empire Recovery Services with two Manhattan addresses, 1430 Broadway Room 402 and 10 W 37th St Room 602, business started 22 November 2016, BBB file opened 16 September 2020, category collections agencies, not accredited. The BBB's rating is F, and it gives two reasons: four complaints filed against the business and failure to respond to all four. The site itself uses both names, Solutions and Services, on the same pages.

The site is written for funders, not for the merchants it calls. It asks, does your company extend credit to merchants and clients, describes the warning signs of a merchant about to default (unusual documentation requests, closed bank accounts, blocked debits, dodged calls), and offers to analyse a funder's book and collect on delinquent accounts. There is no product, no application and no rate anywhere on it.

What it is not: a funder, a lender or a merchant cash advance provider. There is no Empire Recovery advance, no factor rate and no reconciliation clause of its own. If our earlier page led you to expect any of those, disregard it.

Why a business owner hears from Empire Recovery

A funder has placed a defaulted or disputed advance with the agency. Empire Recovery is the funder's agent; the agreement, the debit history and the personal guaranty belong to the funder, and that paperwork decides what can be argued. The agency also appears as a listed creditor or notice party in federal bankruptcy dockets involving small businesses and their owners, which is what an agency holding placed commercial accounts looks like in the public record.

What the complaint record says

The two customer reviews the BBB publishes describe persistent contact from a representative, legal threats the reviewer calls fraudulent, and emails that copied in unrelated third parties with personal information. The BBB's own note is that the business has not answered any of the four complaints filed against it. Read those as descriptions of how the agency has behaved with other people, not as proof about your balance. They do mean that the first useful step is a written request and a paper trail, not a phone argument, and that any threat made on a call should be asked for in writing.

What to establish from your own paperwork

If a lawsuit has been filed

The plaintiff will be the funder, not the agency. Answer before the deadline, usually 20 to 30 days from service; a default judgment ends the negotiation. If a caller says a suit has been filed, ask for the index number and the court, and check it yourself. See what to do if a funder represented through Empire Recovery sues.

Can the balance be settled?

Usually, if the underlying advance is real. Placed MCA balances settle within limits the funder sets, and a documented revenue drop, bank statements and a realistic lump sum or schedule tend to be heard. Get the funder's sign-off in writing before paying an agency with this complaint record. See how a balance Empire Recovery is collecting can be settled.

Business Debt Adjusters reviews the agreement, the debit history and any filings, and tells you what is realistic before you commit to anything.

Frequently Asked Questions

Is Empire Recovery a merchant cash advance company?

No. Empire Recovery Solutions (BBB: Empire Recovery Services) is a New York commercial collection agency started in 2016 whose site says its team are lawyers and experts in the merchant cash advance industry working for funders. It does not fund advances or loans.

Is Empire Recovery legitimate?

It is a real collection business with a published Manhattan address and phone, but it is not BBB accredited and the BBB rates it F for four unanswered complaints. Treat every claim it makes about your balance as something to be verified in writing with the funder.

Why is Empire Recovery calling my business?

A merchant cash advance funder has placed your account with it. Ask in writing which funder, which agreement and what balance, and keep every letter and email; the BBB reviews describe legal threats and emails copied to third parties.

Does the Fair Debt Collection Practices Act apply to an MCA balance Empire Recovery is collecting?

Generally no, because a merchant cash advance is a commercial transaction. State law, New York City collection agency licensing and the general rules against harassment, false legal threats and disclosing a debt to third parties still apply.

What should a business owner do after a call or email from Empire Recovery?

Do not negotiate by phone. Request the funder's name and an itemised balance in writing, ask for any claimed lawsuit's index number and court, pull your agreement and reconciliation history, and get the paperwork reviewed before agreeing to a number.
