A correction first: two companies, not one

Alternative Funding Group Corp. is a Florida corporation based in Fort Lauderdale. The mistake is worth explaining because it is easy to make. Both companies sue merchants in the same upstate New York courts, both use a similar contract structure, and aggregator sites that scrape docket captions sometimes run their names together. The entity named in the first paragraph of your agreement, and the name that appears on your bank statement next to the daily debit, is the one that governs.

What the company says it sells

The company's own merchant cash advance page describes approval amounts from $5,000 to $500,000, a same day answer on the application, funding within 24 to 48 hours of approval, and a document requirement that is usually the last three months of business bank statements. It states that it has said yes to 99 percent of applications and that it has funded nearly $260 million in total. Those are the company's figures, not ours, and we have not verified them against any filing.

Two product descriptions on that page deserve a careful read. The first is the repeated statement that a merchant cash advance "is not a loan" and "carries no interest rate." That is the standard legal position of the industry: the agreement is framed as a purchase of future receivables at a discount, and the cost is expressed as a factor rate rather than an interest rate. Whether a particular agreement is a purchase or a disguised loan is exactly what New York courts examine when a merchant challenges one, so the phrase describes the contract's design, not a settled fact about your file.

The second is a product the site calls reverse consolidation. In the industry that term usually means a new advance whose proceeds are paid to the merchant in weekly instalments sized to cover existing daily debits from other funders, in exchange for a new, longer daily debit to the consolidating funder. It can lower the amount leaving the account each day. It also adds a position and a new balance on top of the ones it services. If you are being offered one, ask for the total payback of the new agreement and compare it against the total remaining on the positions it is meant to relieve before you sign.

Three things in that list are useful to a merchant. First, a Florida funder is suing in upstate New York counties. That almost always reflects a forum selection clause in the agreement that names New York courts, and it means a merchant in Texas or Georgia can be sued in Warren County, New York, and will need to answer there. Second, the Pulse Linx caption names an individual as well as the company, which is what a personal guaranty looks like once it reaches court. Third, the pace: three filings in four weeks in August and September 2025 suggests a funder that moves to litigation within months of a default rather than carrying the position.

We did not find a judgment amount, a confession of judgment, or a decision on the merits in the public listings for any of the four, and we are not asserting one. Case outcomes in the New York Supreme Court are searchable through the court system's public portal by index number, and a merchant who has been named should pull the file rather than rely on a summary.

What a zero complaint record does tell you, and what it does not

Zero complaints on a BBB file that has been open since 7/31/2020 is a meaningful number. It covers more than six years and it sits alongside accreditation, which the BBB can revoke. The BBB reviews page carries a handful of positive reviews and one review from a person who reported repeated calls; the company's reply on that page says it does not make outbound calls and that the reviewer had the wrong company. That exchange is consistent with a business that watches its profile.

What the zero does not tell you is anything about the cost of the money or what happens when a merchant misses payments. Business owners in a merchant cash advance rarely file BBB complaints. They are bound by a contract they signed, the debits are authorised, and the dispute, when it comes, is fought in court under the forum clause rather than through a consumer complaint body. For this class of company the docket is the better record of how the relationship ends, and here the docket shows a funder that files.

If your business is managed from New York, you were owed a disclosure

New York's Commercial Finance Disclosure Law, implemented by the Department of Financial Services in 23 NYCRR Part 600, took effect on February 1, 2023 with a mandatory compliance date of August 1, 2023. It requires a provider making a specific offer of commercial financing of $2,500,000 or less to a business principally directed or managed from New York to disclose, among other items, the amount financed, the finance charge, the annual percentage rate and the payment terms, and it applies to merchant cash advances as well as loans and factoring. Civil penalties run up to $2,000 per violation and up to $10,000 if the violation was wilful.

Given that the company's litigation is concentrated in New York, a meaningful share of its merchants are likely New York businesses. If yours is, and you signed after August 1, 2023, look for that disclosure in your file. Its presence tells you the APR the funder itself calculated. Its absence is a fact worth raising with counsel.

What to establish from your own paperwork

  • The exact entity named in the agreement and on the daily debit. Alternative Funding Group Corp. and Alt Funding Group Corp. are the same company. E Financial Tree is not.
  • The purchased amount, the factor rate, the total payback, and the balance still outstanding, from the payment history rather than from memory.
  • The forum selection clause, so you know which court a suit would be filed in, and whether a personal guaranty was signed.
  • Whether the agreement contains a reconciliation clause, what it lets you request when revenue falls, and what documentation it demands.
  • Whether a UCC financing statement has been filed against the business, which you can check with your state's secretary of state.
  • If the business is run from New York and the agreement is dated after August 1, 2023, whether a Commercial Finance Disclosure Law disclosure is in the file.

Do not stop the debits or move the operating account. Under most agreements of this kind either step is defined as a breach, and it is the event that turns a payment problem into a lawsuit in Warren County.
